  4. END-USER LICENSE AGREEMENT FOR SOURCETEC SOFTWAER CO.LTD.SOFTWARE
  5. PRODUCT(S)
  6.  
  7. IMPORTANT-READ CAREFULLY: This SourceTec End-User License Agreement 
  8. ("EULA") is a legal agreement between you (either an individual or a 
  9. single entity) and SourceTec Software Co. LTD for the SourceTec 
  10. software product(s) identified above. By installing, copying, or 
  11. otherwise using the SOFTWARE, you agree to be bound by the 
  12. terms of this EULA. If you do not agree to the terms of this EULA, 
  13. do not install or use the SOFTWARE.

  17. 1.GRANT OF LICENSE. 
  18.      
  19.     Install and use the Software on a single computer and make one 
  20.     copy of the Software in machine-readable form solely for backup 
  21.     purposes. You must reproduce on any such copy all copyright 
  22.     notices and any other proprietary legends on the original copy 
  23.     of the Software. Install the Software on a storage device, such 
  24.     as a network server, and run the Software on an internal network,
  25.     provided the number of concurrent users does not exceed the number 
  26.     of copies of the Software purchased.  A copy of the Software must 
  27.     be purchased for each such user. If you have purchased a 
  28.     multi-pack license for the Software product, such as a Ten-Pack 
  29.     license, or a license to make multiple installations of the Software,
  30.     you may concurrently use the number of copies of the Software 
  31.     authorized by that purchase. Make copies of the End-User Product and 
  32.     distribute those copies for use solely by yourself or personnel employed 
  33.     by you, or by another party, solely  for its own internal purposes.

  36. 2.COPYRIGHT:
  37.     
  38.     The SOFTWARE is owned by SourceTec Software Co. LTD and is 
  39.     protected by People's Republic of China copyright laws and 
  40.     international treaty provisions.  You may not copy the printed 
  41.     materials accompanying the SOFTWARE (if any), nor print copies of
  42.     any user documentation provided in on-line or electronic form.

  45. 3.OTHER RESTRICTION:
  46.  
  47.     You may not make or distribute copies of the Software, or 
  48.     electronically transfer the Software from one computer to 
  49.     another or over a network. You may not decompile, reverse 
  50.     engineer, disassemble, or otherwise reduce the Software 
  51.     to a human-perceivable form. You may not rent, lease or 
  52.     sublicense the Software.  You may not modify the Software 
  53.     or create derivative works based upon the Software.

  55. 4.SUPPORT SERVICES:
  56.  
  57.     SourceTec provides tech support services related to the SOFTWARE 
  58.     ("Support Services"). Use of Support Services is governed by  
  59.     SourceTec polices and programs described in the user manual, in 
  60.     online documentation, and/or other SourceTec-provided materials. 
  61.     Any supplemental software code provided to you as part of the 
  62.     Support Services shall be considered part of the SOFTWARE and 
  63.     subject to the terms and conditions of this EULA. With respect to 
  64.     technical information you provide to SourceTec as part of the 
  65.     Support Services, SourceTec may use such information for its 
  66.     business purposes, including for product support and 
  67.     development. SourceTec will not utilize such technical 
  68.     information in a form that personally identifies you.

  71. 5. TERMINATION:

  73.     Without prejudice to any other rights, SourceTec may 
  74.     terminate this EULA if you fail to comply with the terms and 
  75.     conditions of this EULA. In such event, you must destroy all copies 
  76.     of the SOFTWARE.

  79. 6. NO WARRANTIES:
  80.    
  81.     SourceTec expressly disclaims any warranty for the SOFTWARE. 
  82.     THE SOFTWARE AND ANY RELATED  DOCUMENTATION IS PROVIDED 
  83.     "AS IS" WITHOUT WARRANT OF ANY KIND, EITHER EXPRESS OR 
  84.     IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES 
  85.     OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR 
  86.     NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR 
  87.     PERFORMANCE OF THE SOFTWARE PRODUCT REMAINS WITH YOU.

  90. 7. LIMITATION OF LIABILITY.

  92.     To the maximum extent permitted by applicable law, in no event 
  93.     shall SourceTec or its suppliers be liable for any special, 
  94.     incidental, indirect, or consequential damages whatsoever 
  95.     (including, without limitation, damages for loss of business 
  96.     profits, business interruption, loss of business information, or 
  97.     any other pecuniary loss) arising out of the use of or inability 
  98.     to use the SOFTWARE or the provision of or failure to provide 
  99.     Support Services, even if SourceTec has been advised of the 
  100.     possibility of such damages.

  102. This EULA is governed by the laws of P.R. China.
